Google: Ad Tech Giant Facing Possible Class Action, More Publisher Lawsuits in Coming Months; Liability Could Stretch Into Billions

Following a favorable April ruling in the federal antitrust lawsuit against Google’s (GOOG) ad-tech business, publishers are likely considering filing their own lawsuits against the company.

The biggest publishers could be looking at hundreds of millions—even billions—of dollars in damages if successful.

And those publishers may soon have deadline to make their decision, as a publisher class action lawsuit’s motion to certify is currently pending in a U.S. District Court, with a decision that could come as soon as this fall. If granted, publishers have some time to choose if they want to have to opt out of the class and file their own lawsuit, which puts the possible deadline into early-to-mid next year.

While the class action addresses a common harm across as many publishers as possible and may be the best option for many of them, a select group of “premium” publishers may have expanded harms that the class action doesn’t address—leaving huge potential damages on the table if they do nothing…
